Tribunal on Violence against Women Human Right Defenders (WHRD)

Acknowledging that women should have equal access to property, Rights and State mechanism;
Accepting Nepal as an insensitive nation towards violence against women, injustice and offence state;
Evaluating that violence against women is increasing all over the country due to current transitional situation;
Internalizing that WHRDs are at risk while raising the voice against violence against women and rights of survivors;
We Jury panel of “Tribunal on Violence against Women Human Right Defenders” strongly recommend the following:
1. State should recognize women human rights defenders and provide identity card to all WHRDs.
2. Maintaining the security situation of the WHRDs is government’s main responsibility. To establish this notion, Nepal government should immediately pass the provision that WHRDs’ security is their responsibility through the implementing mechanism of local administration and Police.
3. The State should immediately enact the act and regulation with special provisions to protection of WHRD.
4. The government should effectively implement the order of Supreme Court regarding violence against women and security of WHRD.
5. Administrative and judicial mechanisms should be established to address violence against women cases within 24 hours.
6. The existing laws, regulations, policies and mechanism related to violence against women should be amended and revised timely and other necessary laws need to be formulated, endorsed and implemented properly.
7. Regarding the necessity and sensitive working environment of WHRDs, security policies should be enacted and a strong supportive mechanism should be established from national to community level. There should be proper concern about the necessities and condition of disable WHRDs and self- representative WHRDs while amending the policies.
8. For the proper security of WHRDs, National Women Commission should be equipped with all authorities and other available resources.
9. In case of violence against women the witnesses were (mainly) women, and this required that State to provide for witness protection policy and its immediate implementation.
10. The State should be responsible to organize interaction program in between the WHRDs, HRDs and Local Administration at least once in a month in each district.
11. All political parties are responsible to make the code of conduct in the issue of violence against women and implement it within their organization compulsorily.
